Complaints and Dispute Resolution Procedure for ProEdge Real Estate

In New Zealand, complaints and dispute resolution procedures related to real estate transactions are primarily governed by the Real Estate Agents Authority (REAA) and the Real Estate Institute of New Zealand (REINZ). Here is an overview of the typical process for handling complaints and resolving disputes in the real estate sector:

Internal Resolution:

If a consumer has a complaint against a real estate agent or agency, they are encouraged to first try to resolve the issue directly with the agent or agency involved. This can often be done through informal communication and negotiation.

Real Estate Agents Authority (REAA):

If the complaint cannot be resolved directly, the next step is to lodge a formal complaint with the Real Estate Agents Authority (REAA). The REAA is an independent government agency responsible for regulating the real estate industry in New Zealand.

Complaints can be submitted online through the REAA’s official website or contact postal at c/-PO Box 25-371 Wellington 6146, New Zealand.

The REAA will review the complaint and investigate the matter further.

Investigation and Mediation:

Upon receiving a complaint, the REAA will investigate the allegations and gather relevant information from both the complainant and the real estate agent/agency.

In some cases, the REAA may facilitate mediation between the parties involved to try and reach a mutually acceptable resolution.

Disciplinary Action:

If the REAA finds that a real estate agent or agency has breached the Real Estate Agents Act 2008 or the Code of Professional Conduct and Client Care, it has the authority to take disciplinary action.

Disciplinary actions can include warnings, fines, suspension of licenses, or even disqualification from practicing as a real estate agent.

Appeals Process:

Both the complainant and the real estate agent/agency have the right to appeal decisions made by the REAA. The appeals process typically involves further review and may lead to reconsideration or modification of the initial decision.

Real Estate Institute of New Zealand (REINZ):

In addition to the REAA, the Real Estate Institute of New Zealand (REINZ) also plays a role in promoting professional standards and ethical conduct within the real estate industry.

Consumers can contact REINZ for guidance or assistance in resolving disputes that may not fall under the jurisdiction of the REAA.

It’s important for consumers to keep documentation and records related to their real estate transactions, as these can be valuable evidence in the event of a dispute or complaint.

Additionally, seeking legal advice or consulting with consumer advocacy organizations can provide further support and guidance throughout the complaint resolution process.
